My car was repossessed and sold at auction by the leasing company. However, they received more money that what I owed, about $3,900. This is because I traded my old car to get the lease. The value of the car I traded was $6,000. The leasing company says that they'll keep the money. I sthis legal?

My car was repossessed but there is a hold on the sale for 7 days waiting for me to pay the back fees. If I file for bankruptcy now will I get it back without having to pay or should I pay and then file?

I tried to turn mine in too. They'll just ignore you and come get it very early one morning or in the middle of the night. just clear out all of you belongings or they will be lost.

Hi Shelly, here is an article found in Upsolve's Learning Center: https://upsolve.org/learn/car-repossession-101/. This should answer most of your questions about the repo man! Good luck ahead! :-)

Hello! When mine was done I worked with the creditor for a convienant time. Technically from the date you file your bankruptcy they cannot reposses for 60 days unless you sign a waiver of that right for that specific car.

Tyler, that's a great MOVE on your part to be ahead of the curve by contacting the Lender FIRST and making convenient arrangements. :-)

My vehicle is at risk of being repossessed and could have been for the last 2 months. The value is far less then what I owe and also, it has a salvaged title due to hail damage. I don't have the option to add a salvaged title while looking up the value so I don't know what that would even be. Plus, I'm not current but is redeeming a vehicle still an option if I did just make the past due balance we order?

I'm not an expert by any means but when you choose the condition of the vehicle when looking up the value, just pick one of the lowest conditions regardless of drivability a salvage title will lower the value so it evens out. Stuff like that isnt to stress over when filing. No worries.

Hi Christian, it depends on the contracts and the fees and costs. I think the article https://upsolve.org/learn/owe-after-repossession/ will help answer your question. If after reading the article you think you are owed money, you might want to consider talking to a https://upsolve.org/learn/what-is-a-consumer-protection-attorney/.

Generally speaking, if there truly is a surplus, it would be yours- but there are often fees and costs associated with repossession that make this unlikely

You'll probably need to review the documents carefully to see what happened in this case- it might be that there were fees for storing the vehicle, costs for the auction, or other fees
