I had my meeting with the trustee on August 13. I have not received anything from the court yet. What should I do?

I'm terrified and anxious! My 341 meeting for Ch. 7 is next week. Dealing with mental health issues, I admit to bad overspending habits, particularly on Amazon and Doordash and borrowed money from my dad every now and again $50-$200 to buy groceries and pay my phone bill. Will this affect my chances at being discharged? Also, do creditors typically show up to the meeting?

While it's called the "Meeting of Creditors" for the most part, a person's creditors don't appear at the meeting. Most people are surprised at how straightforward the process actually is! You can prepare more for the meeting here: https://upsolve.org/learn/mock-341-meeting/

Hi Chelsea! You've conquered the most important part about facing bankruptcy: Admitting your shortcomings and not being in denial. Pat yourself on the back for that! You've just completed the hardest part of your journey - the Questionnaire and that's BIG! I will add to what Claire suggested by including https://upsolve.org/learn/to-do-after-341-meeting/ ---- Your light is getting brighter every day! :-).

Surrendered property can be taken at different points in the process- it depends- sometimes it happens during the automatic stay, if a motion to do so is filed, whereas other times it happens sometime after the 341 Meeting

I had my 341 meeting Nov 4,2021 and deadline creditors Jan 2, 2022. How long before my case is actually closed?

Hi Deborah! Approx 2 months after your 341 meeting. This Upsolve Learning Center provides a timeline: https://upsolve.org/learn/chapter-7-bankruptcy-timeline/ Good luck!

The discharge usually happens 60 days after the 341 Meeting, for a "no-asset" case!

Hi Dottie, A Chapter 7 bankruptcy typically takes about 4 - 6 months to complete after filing. Here is an Upsolve article to give you some guidance: https://upsolve.org/learn/how-long-does-chapter-7-take/

The deadline for creditors to object happens 60 days after the 341 Meeting! Once the deadline to object to the discharge has passed, the court will enter the discharge order.
