I mailed my Bankruptcy Forms / Fee Waiver to the San Diego Courthouse last week. However, I'm unsure if they received it yet and are processing. I didn't include a stamped envelope. I called their automated system, and there is nothing listed under my social security. How long does it typically take for them to process a mailed application? Should I re-print and go in person? They don't have anyone answering phones.

There should be a way to speak to someone in the clerk's office. Did you call yesterday, by chance? Since it was a federal holiday, the court was closed then.

Charity, I'd keep trying to call the court clerk, but you can also keep checking PACER to see if your petition has been filed. Upsolve has a helpful https://upsolve.org/learn/pacer-guide/I think you'll find useful.

I called Tuesday which wasn't a Federal Holiday. The phone option for not having a case # routes and then says something to the effect of that there is nothing setup to answer. I did see the PACER option and guess I have to pay to see if I have something on file. I realized that it takes a week for them to even process fee waivers so I will just keep monitoring over the next 2 weeks. Thanks for the notes. :)

Charity, I just want to point out that although Pacer does charge ten cents per page, the https://pacer.uscourts.gov/help/faqs/how-much-does-it-cost-access-documents-using-pacer# if you accrue less than $30.00 for a quarter. If there's any chance you get email notices from the court (not all courts provide the option), you likely won't be charged when you click on the Pacer link to the new document that's provided in the court notice.

What are the steps in filing for bankruptcy? Is there a certain amount you must be sued for in order to file? How much does it cost? Where do I file?

Glad you're here!! There's not a minimum amount of debt to qualify for Chapter 7 bankruptcy, but many people find that if they have a smaller amount of debt, bankruptcy isn't their best option

My fee in AZ was $338 and I am paying in four installments.
Upsolve Community Member
Julie, thanks for the "installments" idea! The $338 is the Federal fee and applies to all states. If you don't qualify for the waiver, ask the court about installments! :-)

I am eligible for the filing fee to be waived, when do I submit the waiver application? before I file for chapter 7 or send it with my file papers?
Upsolve Community Member
It's submitted at the same time as the rest of the paperwork.

Can anyone inform me of the process? Such as: when I file, do they do an investigation on how I get social security checks and if I own a house, car, property? Thank you for answering.
